Ben advises landowners and their families in connection with partnership agreements, business planning and wealth protection, including how they structure the ownership of their assets to minimise potential capital gains tax and/or inheritance tax liabilities, whilst ensuring the safe passage of assets to the next generation.
He identifies risks for farmers to protect their payments under the basic payment scheme/agri-environmental agreements when renting, buying or selling land/farms.
Ben acts for family farming businesses, landowners, estates, hobby farmers, tenants and those who operate share-farming or contract-farming arrangements.
Recent examples of how Ben has helped clients include:
- the sale of a 250-acre arable farm for in excess of £3 million on behalf of a family who were ceasing to farm;
- protecting a family’s assets to ensure the safe transfer to the next generation of agricultural land with development potential worth circa £8 million; and
successfully negotiating with HMRC to defer an inheritance tax liability by structuring the ownership of assets to maximise available inheritance tax reliefs and exemptions relating to an estate valued at in excess of £2 million.
